1. The R&D super deduction: what it is and who can use it

The super deduction (also called the additional R&D deduction) allows an enterprise to deduct eligible R&D expenses twice for corporate income tax: once as the actual expense, and once more as an additional 100% deduction. For expenses capitalised as intangible assets, the asset is amortised at 200% of cost. Who is excluded

A negative list excludes enterprises whose main business falls in industries such as tobacco manufacturing, accommodation and catering, wholesale and retail, real estate, leasing and business services, and entertainment. Routine product upgrades, direct application of existing public technology, and after-sales quality activities do not count as R&D.

2. HNTE status: the 15% rate and its qualification tests

High and New Technology Enterprise certification is awarded for three years and is renewable. The headline benefit is a 15% CIT rate instead of 25%; certified companies also enjoy a ten-year tax-loss carryforward (versus the standard five) and, in many cities, preferential treatment in grants and government programmes.

Note: Certification is reviewed by provincial-level science, finance and tax authorities. Meeting the numeric thresholds is necessary but not sufficient — evaluators also score the quality of R&D organisation, IP relevance and conversion of research into products.

3. How the two incentives interact

The super deduction reduces taxable income; HNTE status reduces the rate applied to that income. A profitable HNTE company with RMB 10 million of eligible R&D deducts RMB 20 million and pays 15% on the result — a combined benefit up to RMB 3 million versus no incentives. One interaction to plan for: the super deduction can push a marginally profitable company into a tax-loss position, in which case the rate benefit of HNTE is deferred rather than lost, because HNTE companies carry losses forward for ten years.

  • R&D project files: approved project proposals with objectives, budgets, timelines and staffing for each project claimed.
  • Auxiliary R&D ledger: a dedicated expense ledger mapping every claimed cost to a project, reconciled to the statutory accounts.
  • Personnel evidence: contracts, timesheets or allocation logic for R&D staff; shared staff must be split on a defensible basis.
  • IP records: patent and software-copyright certificates linking owned IP to the products that generate high-tech income.

5. Common failure patterns

  1. Claiming without projects. Expenses gathered at year-end without contemporaneous project definitions rarely survive review.
  2. Using licensed IP for HNTE. Core IP must be owned by the applicant; a licence from the foreign parent does not satisfy the test — plan IP assignment or local development early.
  3. Mixing production and R&D costs. Materials and staff time split between manufacturing and R&D need an allocation method applied consistently, not an estimate.
  4. Ignoring the industry negative list. Companies whose main business is on the excluded list cannot claim the super deduction even if they run genuine research activities.
  5. Treating HNTE as permanent. The certificate lasts three years and requires re-application; the underlying ratios must be maintained every year, not just in the application year.
